New BCCI proposal to regulate employee-employer relations
The Bahrain Chamber of Commerce and Industry (BCCI), has suggested a roadmap regulating employer-expatriate relations, following the ban of sponsorship system.
As per the proposal, expat workers will be permitted to switch jobs only after honouring at least half of the contract. The proposal makes way for employers to recover the expenses paid towards recruitment of expatriates.
The Labour Minister, Dr Majeed Al Alawi, said that in case the expat worker fails to honour the period stipulated in the contract, their employer can claim for all expenses, including travel, training and other payments.
Under the proposal, the employers have the right to ban their expatriate employees from joining their direct Bahraini competitors for minimum of one year.
A model work for the same can be signed between the parties and specify conditions for swapping jobs, it has been suggested.
The BCCI also emphasized the need for new-look contract to include an article banning the expatriates from revealing the business secrets of their former employers.
This contract term would be applicable to expatriates holding sensitive positions. The proposal stipulates that LMRA (Labour Market Regulatory Authority) would ensure that expats remain totally committed to their contract terms before giving them the green signal.
